Allows operators of motorcycles or mopeds to pass vehicles in same lane
during traffic slowdowns.
Allows operators of motorcycles or mopeds to travel between lanes of
traffic or between
adjacent lines or rows of vehicles during traffic slowdowns.
A BILL FOR AN ACT
Relating to unlawful passing; amending ORS 814.240.
Be It Enacted by the People of the State of Oregon:
SECTION 1. ORS 814.240 is amended to read:
814.240. (1) A motorcycle operator or moped operator commits the offense
of motorcycle or
moped unlawful passing in a lane with a vehicle if the operator does any
of the following:
(a) Overtakes and passes in the same lane occupied by the vehicle the
operator is overtaking,
unless the vehicle being passed is a motorcycle or a moped.
(b) Operates a moped or motorcycle between lanes of traffic or between
adjacent lines or rows
of vehicles.
(2) Notwithstanding subsection (1) of this section, when traffic is
stopped or has slowed
to a speed of less than 10 miles per hour, a motorcycle or moped
operator may:
(a) Overtake and pass in the same lane occupied by the vehicle the
operator is overtaking.
(b) Operate a motorcycle or moped between lanes of traffic or between
adjacent lines or
rows of vehicles.
(3) A motorcycle or moped operator proceeding as described in subsection
(2) of this
section may not exceed a speed of 20 miles per hour.
[(2)] (4) This section does not apply to a police officer in the
performance of official duties.
[(3)] (5) The offense described in this section, motorcycle or moped
unlawful passing in a lane
with a vehicle, is a Class B traffic violation.
